The rules for using the Department of Creative Pursuits website, DOCP OS member platform, studios, and events.

§ 00 — Legal Review Notice

These terms are written in plain language as a working baseline for launch. They should be reviewed and approved by qualified legal counsel before you rely on them for any regulated or high-stakes matter.

§ 01 — Acceptance

By creating an account, booking a studio, purchasing a membership, attending an event, or otherwise using DOCP services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.

§ 02 — Accounts

You may create an account with email/password or with Google Sign-In. You are responsible for keeping your credentials secure and for activity under your account. Accounts are for one person; do not share credentials. You must be at least 18 years old to create an account, or 13+ with a supervising adult member.

We may suspend or terminate accounts for violations of these Terms, our house rules, applicable law, or for behavior that endangers staff, members, or property.

§ 03 — Membership

Memberships grant access to the benefits described at the time of purchase. Membership fees are billed on a recurring schedule until canceled. You may cancel from your account; cancellation stops the next renewal and does not automatically refund fees already paid. We may change plans, benefits, and pricing with reasonable notice; changes apply to the next billing cycle.

§ 04 — Studio and Event Bookings

Bookings are confirmed when payment (if required) is captured and you receive a confirmation. You are responsible for guests you bring, for using the space within its stated capacity and posted rules, and for leaving the space in the condition you found it. We may cancel or reschedule bookings for safety, maintenance, or double-booking; in those cases we will refund or reschedule.

§ 05 — Payments

Payments are processed by Stripe. By providing payment information, you authorize us and Stripe to charge the amounts shown at checkout, including taxes and applicable fees. Failed charges may result in loss of access to bookings, access grants, or membership benefits.

§ 06 — Promo Codes

Promo codes are limited-use, non-transferable, have no cash value, and are subject to the terms shown when issued. We may deactivate codes obtained through unauthorized channels or used in violation of their terms.

§ 07 — Access and Kisi

Confirmed bookings and eligible memberships grant temporary door access through Kisi for the booked resource and time window. Access grants are personal to the account holder, are not transferable, and may be revoked at any time. Do not prop, share, or bypass access hardware. You are responsible for anyone you admit to the building.

§ 08 — Agreements, Signatures, and COI

Some bookings require you to accept a booking agreement and, where applicable, upload a Certificate of Insurance naming DOCP as additional insured. Electronic acceptance is legally binding. You confirm you have authority to sign on behalf of any organization you represent.

§ 09 — Google Calendar Sync

Confirmed bookings are copied to a shared internal Google Calendar used by DOCP staff to coordinate the space. This sync is operational, not a customer-facing calendar; do not rely on the shared calendar as your personal record.

§ 10 — Creative Index and Public Profiles

If you publish a Creative Index profile or opt into the member directory, you grant DOCP a non-exclusive, royalty-free license to display the content you submit (name, discipline, bio, links, photo) on DOCP-operated surfaces for the purpose of running those features. You retain ownership of your content. You may unpublish or edit your profile at any time.

§ 11 — Residency and Applications

Residency and program applications are reviewed by DOCP staff. We may accept, waitlist, or decline any application at our discretion. Submission of an application does not create an obligation to admit, hire, or contract with the applicant.

§ 12 — Acceptable Use

Do not use the platform to harass, defame, or endanger others; to upload malware or infringing content; to attempt unauthorized access; to scrape at abusive rates; or to impersonate another person. In physical spaces, follow posted safety rules, staff instructions, and applicable law. Firearms, illegal substances, and unsafe operation of equipment are prohibited.

§ 13 — Content You Submit

You represent that you own or have rights to any content you upload (photos, files, applications, COI documents). You grant DOCP the limited rights needed to store, display, and process that content for the service.

§ 14 — Third-Party Services

DOCP OS uses Supabase (backend), Stripe (payments), Google (Sign-In and Calendar), Kisi (access), and email delivery providers. Your use of features that touch those services is also subject to their terms. We are not responsible for third-party services beyond our reasonable control.

§ 15 — Disclaimers

The services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free service. Physical spaces carry inherent risks associated with creative and production work; use them at your own risk and follow posted rules.

§ 16 — Limitation of Liability

To the maximum extent permitted by law, DOCP will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability for any claim arising out of the services is limited to the greater of $100 USD or the amounts you paid us in the twelve months before the claim.

§ 17 — Indemnification

You agree to indemnify and hold DOCP harmless from claims arising out of your use of the services, your violation of these Terms, your violation of applicable law, or your content.

§ 18 — Termination

You may stop using the services at any time and request account deletion. We may suspend or terminate accounts, bookings, or access for violations of these Terms or where continued use would harm the service, staff, or members. Sections that by their nature survive termination (payment obligations, disclaimers, liability limits, indemnification, governing law) will remain in effect.

§ 19 — Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Exclusive venue for disputes not subject to arbitration or small-claims court lies in the state and federal courts located in Denver County, Colorado.

§ 20 — Changes

We may update these Terms. Material changes will be announced by email or an in-platform notice. Continued use of the services after changes take effect constitutes acceptance.
